21-week babyState legislators in North Dakota are sending a message to abortionists who refuse to save babies born alive during an abortion.

In 1977, lawmakers passed a Born Alive Abortion Survivors Protection Act.

Dal Bartscher of South Dakota Right to Life tells One News One it was one of the first such laws passed in the country.

“But here we are, 44 years later,” he says, “and we're continuing to pursue a culture of life.”

State lawmakers have now updated and strengthened the old state law with penalties for abortionists and with reporting requirements.

“For a doctor to be a participant in this,” the pro-lifer warns,” it would be a $10,000 fine and then also the possibility that this doctor may lose his or her practicing license."

The reporting measure is important because most states do not collect data on babies born alive in abortions or their gestational age, and whether the children survived with or without medical help.
