Will precedent or the Ninth Circuit prevail?

crisis pregnancy centerCalifornia will have plenty of opportunities to defend its new law regulating pro-life pregnancy centers, but attorneys representing the pro-lifers are positive about defending their clients.

The new law that Governor Jerry Brown signed this week will go into effect January 1, unless a court overturns it. Two Christian legal organizations have already filed suit, and now the National Institute of Family and Life Advocates have joined them.

Attorney Thomas Glessner tells OneNewsNow the first requirement of the law is for the pro-life centers to post a sign referring women to someplace they can obtain free or low-cost abortions.

"Clearly the objection to having to give out abortion referral information to patients who come in is a clear violation of religious conscience," Glessner asserts. "Our pregnancy centers exist to provide alternatives to abortion, are pro-life in nature, and do not refer for abortion in any way, shape, or form."

Under the new law, non-medical pro-life centers would have to post a notice in their waiting areas and advertising declaring that they do not have on staff a licensed doctor and that they are not a licensed medical clinic.

But Glessner notes that his firm has won cases against similar ordinances, including in the state of Maryland.

"In Texas, an Austin city ordinance was enjoined by a court," the attorney continues, "so we feel like the court precedent is on our side and that we're eventually going to prevail. But we do have to realize that our suit is in the Ninth Federal Circuit, and that is the most liberal federal circuit in the country."

But it is also the most overturned federal circuit court.
