The legal battle continues over an organization demanding the right to fly a Christian flag at city hall in Boston where numerous other flags have flown.
Matt Staver, attorney and founder of Liberty Counsel, says he recently filed a notice of appeal after a judge ruled twice against his client, Hal Shurtleff and his group Camp Constitution.
Shurtleff sued after the City of Boston refused to hoist the flag to celebrate Constitution Day in 2017, and Liberty Counsel is arguing the city's action amounted to unlawful discrimination after the city admitted it refused to fly the flag because it is a religious symbol.
Meanwhile, Staver says there have been hundreds of flags hoisted.
"They have about 300 flags,” he says, “none of which had been censored, and only one had been censored and that is this one here."
Liberty Counsel expects to argue its appeal later this year with a decision before the end of the year.
“I think once we get to a higher court,” Staver predicts, “we'll ultimately win the day."
