Judge gives abortion clinic free rein

gavel with stethoscopeThe state of Indiana is clashing with the courts over the operation of an abortion clinic.

Jackie Appleman, executive director of St. Joseph County Right to Life, tells OneNewsNow Whole Woman's Health has been fighting the state for a license to do abortions in South Bend, Indiana.

"They were initially denied their license because of disreputable character and because they have health code violations in their other clinics that are in other states," she explains. "And since they kept getting denied because they cannot comply with the law, they try to get around the law by petitioning to a federal judge to open without a license."

The court has issued a formal order allowing that to happen, and the clinic is already terminating children through chemical abortion.

"Technically, Whole Woman's Health is supposed to still follow all of the other regulations the state has in place," Appleman says. “I think they're still subject to inspections, but there's no enforcement process in place. The judge basically gave them free rein to do what they want with no oversight."

In other words, the state could discover serious health and safety violations at Whole Women's Health, but because of the court order, the clinic would still be able keep its doors open. The pro-lifer adds, however, that the attorney general's office is working on an appeal to determine whether the state can enforce its own standards or if the courts can allow abortion clinics to seek out a federal judge who will overturn the state.
