After Obamacare was ruled unconstitutional on Friday, Democrats are up-in-arms and lashing out at a Texas judge for calling for an end of the Affordable Care Act (ACA) – with many now demanding “Medicare for all.”
With the decision that could instantly interrupt millions of Americans’ health insurance during Obamacare’s current six-week open enrollment period, it is already anticipated that Democrats will appeal the decision until it reaches the United States Supreme Court (SCOTUS).
Lone Star State not alone
Texas is not the only state citing problems with former President Barack Obama’s questionable signature healthcare program that was set up during his first term in office.
“Texas – along with 19 states – had argued to U.S. District Judge Reed O’Connor that they had been hurt by a jump in the amount of people utilizing state-backed insurance,” Fox News reported. “When Congress cut the tax penalty from the program in 2017 – the states claimed – it essentially undercut the Supreme Court’s reasoning for finding former President Barack Obama’s signature legislation constitutional in 2012.”
Holder not holding back …
Shortly after O’Connor declared Obamacare unconstitutional, it was voiced by key Democrats that the decision did not settle well with them, including Obama’s Attorney General Eric Holder – who has seen his share of corruption charges over the years. He went as far as scolding the judge via social media for his decision.
“There will be appeals of this absurd decision, but it’s time to mobilize – Obamacare is at stake,” Holder tweeted Saturday. “Contact your Congressman and Senators … let them know how mad – and focused – you are. Be heard. Be seen. Apply pressure. And fight the McConnell court packing.”
The nation’s former top cop made some serious charges against his political adversary in Texas’ judicial system.
“After an election in which the fate of Obamacare protections were decisive, a single, hard right judge destroys the system, and defeated Republicans support this,” Holder added in another Saturday tweet. “It is time to move to some version of Medicare for all and end this nonsense.”
The claim of ACA’s flawed foundations that many Obamacare critics have cited since its inception was backed by the U.S. House of Representatives in 2017, when it argued that forcing taxpaying citizens – under the threat of penalties – to purchase a service that they did not want actually flies in the face of the U.S. Constitution.
“Last year, Congress invalidated the tax penalty for not purchasing insurance, which opened up [the] doors for the constitutionality of Obamacare to be challenged,” the Gateway Pundit recounted. “The repeal of the tax penalty is precisely what the Republicans needed to kill Obamacare – one of the biggest scams of redistribution of wealth this country has ever seen.”
It is contended that Obamacare was merely a Trojan Horse that Democrats have been using to set up their healthcare system based on socialist principles.
“Now the Dems are pushing for universal healthcare – this was their plan all along,” Gateway Pundit’s Cristina Laila asserted. “Obamacare was merely the vehicle to usher in universal healthcare.”
Other key Dems not happy
Rep. Sheila Jackson Lee (D-Texas) and other key Democrats are accusing Republicans of jeopardizing the health of young and old Americans – and especially the infirm.
“Democrats are going to fight and fight to restore protection not only for pre-existing conditions, but for Obamacare,” Lee tweeted Saturday. “The Republicans have let children, senior citizens and the sick out in the cold.”
The ultra-left Sen. Jeff Merkley (D-Ore.) echoed Lee’s charge against conservatives over the attack on Obamacare before threatening legal action to reverse the controversial ruling.
“The diabolical Republican plan to strip health care from millions of Americans just took a big step forward,” Merkley posted Saturday on Twitter. “Now the fight goes to the circuit court. Time for Medicare for all.”
Failed presidential candidate Sen. Bernie Sanders (I-Vt.) also chimed in his contempt for the Texas judge’s decision against Obamacare, insisting that now is the time to make health care a right for all Americans – from coast to coast.
“This is an outrageous, disastrous decision that threatens the health care and lives of millions of people,” Sanders tweeted Saturday. “It must be overturned. We must move forward to make health care a right for every American.”
Supporters of the self-proclaimed socialist who share his mindset of making the government pay for “pizza for everyone!” are urging Democrats to push forward an unadulterated form of Obamacare that has socialism written all over it.
“House Democrats can pass #MedicareforAll THIS session and campaign on it,” People For Bernie tweeted Saturday. “No watered down version. Any bill that keeps in place the current for-profit insurance system keeps in place the same power structures that created this mess.”
Sen. Elizabeth Warren (D-Mass.) – a.k.a. “Pocohontas” for her bogus claim of being a Native American – argued that the Texas judge’s decision declaring Obamacare unconstitutional was nothing less than a right-wing conspiracy in the judicial system.
“The GOP know that they can’t repeal the ACA in Congress, [s]o they’ve continued their crusade through the courts – and a right-wing judge in Texas ruled in their favor,” Warren proclaimed to her Twitter followers Saturday. “Let’s be very clear: the ACA is still the law of the land.”
Good news for conservatives
The decision of O’Connor – a conservative Republican-appointed judge who has blocked other problematic policies administered under the Obama administration – did not pick apart just a part of Obamacare – it tore away its very core.
“The remainder of the ACA is non-severable from the individual mandate – meaning that the Act must be invalidated in whole,” O’Connor wrote in his 55-page opinion, according to Bloomberg.
Trump took to Twitter to applaud O’Connor and announce the ruling to his tens of millions of Twitter followers.
"As I predicted all along, Obamacare has been struck down as an UNCONSTITUTIONAL disaster," Trump tweeted after the ruling. "Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions. Mitch and Nancy, get it done!"
He declared the decision as ultimately a victory for all Americans.
"[O’Connor’s ruling is] great news for America!" Trump’s following tweet proclaimed.
Opposition ahead …
In addition to former U.S. Attorney General Holder’s condemnation of the Texas judge’s ruling, California Attorney General Xavier Becerra – as well as other states supporting Obamacare – are seething after the setback and expected to appeal the move by the U.S. Court of Appeals of the Fifth Circuit.
“Today’s ruling is an assault on 133 million Americans with pre-existing conditions, on the 20 million Americans who rely on the A.C.A.’s consumer protections for health care, on America’s faithful progress toward affordable health care for all Americans,” Becerra expressed in a statement, according to the New York Times. “The A.C.A. has already survived more than 70 unsuccessful repeal attempts and withstood scrutiny in the Supreme Court.”
Senate Minority Leader Chuck Schumer (D-N.Y.) – who has unconditionally stood behind Obamacare, even after its enrollment portal recently breached the security of 75,000 applicants – also took a hard stand against O’Connor’s decision.
"The ruling seems to be based on faulty legal reasoning and, hopefully, it will be overturned," Schumer tweeted after the decision. "Americans who care about working families must do all they can to prevent this district court ruling from becoming law."
House Minority Leader Nancy Pelosi (D-Calif.) also aired her frustration and dismay over the decision.
“While the district court’s absurd ruling will be immediately appealed, Republicans are fully responsible for this cruel decision and for the fear they have struck into millions of families across America who are now in danger of losing their health coverage," Pelosi contended in a statement,” according to Fox News. "When House Democrats take the gavel, the House of Representatives will move swiftly to formally intervene in the appeals process to uphold the life-saving protections for people with pre-existing conditions and reject Republicans’ effort to destroy the Affordable Care Act.”
But White House Press Secretary Sarah Huckabee Sanders commended O’Connor for his bold ruling targeting the core principles behind Obamacare.
“Obamacare has been struck down by a highly respected judge," Sanders impressed in a statement, according to Fox News. "The judge’s decision vindicates President Trump’s position that Obamacare is unconstitutional.”
Moving forward, Sanders indicated that socialized medicine will have no part in America’s future – even after anticipated challenges by Democrats, socialists and others on the far-left.
“Once again, the president calls on Congress to replace Obamacare and act to protect people with preexisting conditions and provide Americans with quality affordable healthcare,” Sanders continued. “We expect this ruling will be appealed to the Supreme Court. Pending the appeal process, the law remains in place.”
