gun store assault weaponsSecond Amendment advocacy groups are asking the U.S. Supreme Court to overturn a California county's ban on gun stores.

Alan Gottlieb of the Second Amendment Foundation says SAF is fighting an Alameda County ordinance that uses zoning laws to keep out firearms stores.

Alameda has a population of approximately 1.6 million and includes the county seat of Oakland and famously far-left Berkeley.

"There is no place to buy a gun in Alameda County," Gottlieb says, "and so the Second Amendment Foundation, along with Calguns Foundation and other organizations and individuals, filed suit."

Attorneys for the gun-rights groups petitioned the high court on Jan. 10 to intervene, The Washington Free Beacon reported this week.

A three-judge panel at the 9th Circuit Court of Appeals ruled in favor of the plaintiffs but that decision was later overturned by the full 9th Circuit.

Now that the full 9th Circuit effectively ruled in favor of using zoning laws to outlaw gun stores, are other cities and counties attempting to enact similar restrictions.

"That's why it's important," says Gottlieb, "for the U.S. Supreme Court to now get involved."

The high court has been reluctant in past years to accept gun cases, drawing rebuke from conservative justices over the "distressing trend" of treating the Second Amendment as a "disfavored right," the Free Beacon story recalls.
