State Supreme Court stops same-sex unions

While no Alabama probate judges are under a federal court order to issue same-gender marriage licenses, a constitutional expert says the secular media is reporting the decision incorrectly.

When Mobile, Alabama Federal Judge Callie Granade overturned Alabama's constitutional amendment on marriage, the state Supreme Court ordered probate judges to halt on issuing same-gender marriage licenses. But then activists sued again to force the probate judge in Mobile to issue the licenses.

"Federal Judge Grenade has now issued a ruling that says there's no reason for her to modify her decision because it no longer has any impact on the probate judge in question," reports Mat Staver of Liberty Counsel. "That means that obviously the Alabama Supreme Court decision that says no probate judges can issue same-sex marriage licenses is binding across the state and no judge can violate that."

Staver believes the media has reported it incorrectly by giving an edge to same-gender marriage.

"The fact of the matter is same-sex marriages have stopped in Alabama. The federal judge's decision is limited, and the effect is done; it's over," he comments. "The Alabama Supreme Court is the law, and that is binding on all probate judges, and no probate judge in Alabama can issue same-sex marriage licenses."

Liberty Counsel worked with the Alabama Supreme Court to successfully bring an end to same gender marriage in Alabama.
